## 2. ACCEPTANCE OF THESE TERMS
2.1 By accessing the Website, creating an account, or placing an order, you agree to be bound by these Terms, together with our Delivery and Refund Policy and our Privacy Policy, all of which are incorporated by reference.
2.2 If you do not agree to these Terms, you must not use the Website.
2.3 **Please read clauses 9 (Limitation of Liability), 13 (Governing Law and Jurisdiction) and 14 (Indemnity) carefully. They limit our liability and impose obligations on you.** Nothing in these Terms is intended to limit or exclude any right you have under the Consumer Protection Act 68 of 2008 ("**CPA**") or ECTA that cannot lawfully be limited or excluded.
2.4 You confirm that you are at least 18 years old and have full legal capacity to contract, or that you have the assistance of your parent or legal guardian. We may refuse or cancel any order placed by a person we reasonably believe lacks capacity.
---
## 3. YOUR ACCOUNT
3.1 You may need to register an account to place an order. You must provide accurate, current and complete information and keep it updated.
3.2 You are responsible for keeping your password confidential and for all activity on your account. Notify us immediately at hishandiworkza@outlook.com if you suspect unauthorised access.
3.3 We may suspend or terminate your account, without notice, if we reasonably believe you have breached these Terms, provided false information, or used the Website unlawfully or fraudulently.
---
## 4. PRODUCTS, PRICING AND AVAILABILITY
4.1 We take reasonable care to describe and depict our products accurately. Images, colours and packaging are illustrative and may differ slightly from the actual product. Minor variations do not constitute a defect.
4.2 All prices are shown in South African Rand (ZAR) and include VAT at the prevailing rate. Delivery charges are shown separately at checkout before you confirm your order.
4.3 Prices and product availability may change at any time before your order is accepted. Products are subject to availability and stock levels are not guaranteed.
4.4 **Pricing errors.** We make every effort to display correct prices. Where a product is displayed at an obviously and materially incorrect price as a result of an unintentional error, and we correct that error by notifying you before accepting your order and by promptly correcting the display, we are not bound by the incorrect price (section 23(9)–(10) of the CPA). In that event we will contact you and you may confirm the order at the corrected price or cancel it for a full refund of any amount already paid.
4.5 Promotions, discount codes and special offers are subject to their own terms, are valid only for the stated period or while stocks last, and may not be combined unless we say so.
---
## 5. ORDERS AND FORMATION OF CONTRACT
5.1 Your order is an **offer** to purchase. Adding items to your cart or receiving an automated order-acknowledgement email does **not** constitute acceptance.
5.2 A binding sale agreement comes into existence only when we send you a written order confirmation confirming acceptance, whichever we specify in that communication.
5.3 We may decline any order, in whole or in part, for good reason — including where the product is out of stock, where payment is not received or is flagged as fraudulent, where a pricing or description error occurred, where we cannot deliver to your address, or where you have breached these Terms. If we decline your order after payment, we will refund you in full.
5.4 Before finally placing your order you will have an opportunity to review the full order, the total price, and to correct any input errors. It is your responsibility to check your order and delivery address before submitting it.
5.5 We may impose reasonable quantity limits per customer or per order.
---
## 6. PAYMENT
6.1 We accept the following payment methods: e.g. credit and debit card via PayFast
6.2 Payment must be received and cleared in full before goods are dispatched. Ownership of the goods passes to you only once we have received full payment.
6.3 Card and payment processing is handled by our third-party payment gateway, PAYFAST, over a secure encrypted connection. We do not store your full card details on our systems.
6.4 You warrant that you are authorised to use the payment method you select and that there are sufficient funds available.
6.5 Where you pay by EFT, your order will be held for [3] business days pending receipt of funds and will be released automatically if payment is not received.
---
## 7. DELIVERY
7.1 We deliver within the borders of the Republic of South Africa only, unless otherwise agreed in writing.
7.2 We aim to deliver all orders **within 10 (ten) working days** of the order being accepted and payment clearing. Full details of delivery, our delivery partners (Pargo and The Courier Guy), delivery charges, collection points and what happens if delivery fails are set out in our **Delivery and Refund Policy**, which forms part of these Terms.
7.3 Delivery timeframes are estimates based on our delivery partners' service levels. Where a delay occurs, we will notify you as soon as reasonably possible. If we are unable to deliver within the agreed period, you may accept a revised delivery date or cancel the order for a full refund, without penalty.
7.4 Risk of loss or damage to the goods passes to you on delivery to you, or to any person at the delivery address who accepts the goods, or on collection from a Pargo point.
7.5 You must provide a correct, complete and accessible delivery address and a contactable mobile number. We are not liable for failed or delayed delivery caused by incorrect or incomplete address details, or by your unavailability to accept delivery. Re-delivery charges arising from your error will be for your account.
---
## 8. CANCELLATIONS, RETURNS AND REFUNDS
8.1 **Cooling-off period (ECTA section 44).** As this is an electronic transaction, you may cancel your order without reason and without penalty within **7 (seven) days** after the date you receive the goods. You are responsible only for the direct cost of returning the goods to us. Where you have already paid, we will refund you within **30 (thirty) days** of cancellation.
8.2 The cooling-off right in clause 8.1 does not apply to the categories of goods and services excluded by section 42(2) of ECTA, including goods made to your specifications or clearly personalised, goods that by their nature cannot be returned or that deteriorate or expire rapidly, and audio or video recordings or computer software where the seal has been broken by you.
8.3 **Defective goods (CPA sections 55 and 56).** You are entitled to goods that are of good quality, in good working order, free of defects, reasonably suitable for their intended purpose and durable for a reasonable period. If, within **6 (six) months** of delivery, the goods fail to meet these requirements, you may return them at our risk and expense and choose whether we repair or replace them, or refund you.
8.4 **Other return rights (CPA section 20).** You may also return goods and receive a refund where we delivered goods you did not have an opportunity to examine and you reject them on delivery, or where you told us before the sale what particular purpose the goods were intended for and within 10 business days of delivery you find they are unsuitable for that purpose. Where goods are returned on these grounds and have been used, unpacked or have depreciated in value, we may charge a reasonable handling and restocking fee of up to 10% of the purchase price, as permitted by section 20(6) of the CPA.
8.5 We are not obliged to accept returns of goods that have been damaged, altered, misused, used contrary to instructions, or damaged after delivery by you or by anyone other than us.
8.6 The full return procedure, timeframes, return address and refund methods are set out in our **Delivery and Refund Policy**.

## 9. WARRANTIES AND LIMITATION OF LIABILITY
9.1 Except for the statutory warranties described in clause 8 and any written manufacturer's warranty supplied with the goods, and to the maximum extent permitted by law, the Website and its content are provided "as is" and "as available", without further warranties of any kind.
9.2 We do not warrant that the Website will be uninterrupted, error-free, secure or free of viruses, or that any defect will be corrected.
9.3 To the maximum extent permitted by law, we will not be liable for any indirect, incidental, special, punitive or consequential loss or damage, including loss of profit, loss of business, loss of data or loss of goodwill, arising from your use of the Website or from any product purchased.
9.4 Where our liability cannot lawfully be excluded, our total aggregate liability to you arising from any order is limited to the total amount you actually paid for that order.
9.5 **Nothing in this clause 9 limits or excludes our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, for any liability under section 61 of the CPA (harm caused by goods), or for any other liability that cannot lawfully be limited or excluded.** In particular, and as required by section 51 of the CPA, we do not seek to exclude liability for gross negligence.
9.6 We are not liable for any failure or delay in performing our obligations caused by an event beyond our reasonable control, including load shedding, fire, flood, extreme weather, civil unrest, riot, strike, national disaster, epidemic, war, acts of government, failure of telecommunications or internet infrastructure, or failure of our courier partners.

## 10. INTELLECTUAL PROPERTY
10.1 All content on the Website — including the trade marks, logos, product names, text, graphics, photographs, videos, page layout, design and software — is owned by or licensed to us and is protected by South African and international intellectual property law.
10.2 You may view, download and print content from the Website for your own personal, non-commercial use only. You may not reproduce, distribute, modify, publish, transmit, sell, licence or create derivative works from any content without our prior written consent.
10.3 Nothing on the Website grants you any licence or right to use any trade mark displayed on it.

## 11. YOUR CONDUCT AND PROHIBITED USE
11.1 You may not use the Website:
(a) for any unlawful, fraudulent or malicious purpose;
(b) to transmit any virus, worm, trojan, or other harmful code;
(c) to gain or attempt to gain unauthorised access to the Website, our servers, or any connected system;
(d) to scrape, harvest, data-mine, spider or use any automated system to extract data from the Website;
(e) to interfere with or disrupt the Website or its infrastructure; or
(f) to post or transmit content that is defamatory, obscene, discriminatory, harassing or that infringes the rights of any person.
11.2 We reserve the right to report any suspected unlawful activity, including contraventions of Chapter 13 of ECTA (unauthorised access to, interception of or interference with data), to the South African Police Service and to cooperate fully with any investigation.
---
## 12. PRIVACY AND PERSONAL INFORMATION (POPIA)
12.1 We process your personal information in accordance with the Protection of Personal Information Act 4 of 2013 ("**POPIA**") and our Privacy Policy, available at Terms of service – Hishandiwork.
12.2 By placing an order you consent to us collecting, processing and storing your personal information for the purposes of processing your order, arranging delivery, providing customer support, processing payments, complying with our legal obligations, and — where you have opted in — sending you marketing communications.
12.3 We share your personal information with third parties only to the extent necessary, including our payment gateway, our delivery partners (Pargo and The Courier Guy) and our hosting and e-commerce providers. These parties are required to protect your information.
12.4 You may object to the processing of your personal information, request access to it, or request correction or deletion, by contacting our Information Officer at MARCUS THORPE-FAIRALL at HISHANDIWORKZA@OUTLOOK.COM. You may also lodge a complaint with the Information Regulator (South Africa) at enquiries@inforegulator.org.za.
12.5 You may unsubscribe from marketing communications at any time using the unsubscribe link in any message or by contacting us.

## 13. GOVERNING LAW, DISPUTES AND JURISDICTION
13.1 These Terms and any sale concluded under them are governed by the laws of the Republic of South Africa.
13.2 **Internal resolution first.** If you have a complaint, please contact us first at HISHANDIWORKZA@OUTLOOK.COM. We will acknowledge your complaint within [3] business days and aim to resolve it within [15] business days.
13.3 If we cannot resolve the dispute, you are entitled to refer the matter to an accredited consumer ombud, an alternative dispute resolution agent, the relevant provincial Consumer Affairs Office, or the National Consumer Commission, in terms of section 69 of the CPA.
13.4 Subject to clause 13.3, you consent to the jurisdiction of the Magistrates' Court having jurisdiction over your person in terms of section 45 of the Magistrates' Courts Act 32 of 1944, notwithstanding that the amount in dispute may exceed that court's ordinary monetary jurisdiction. This does not prevent us from instituting proceedings in a High Court with jurisdiction.
13.5 A certificate signed by any of our managers (whose appointment need not be proved) as to the amount owing by you will be prima facie proof of that amount for the purpose of obtaining judgment.
---
## 14. INDEMNITY
You indemnify us and hold us harmless against any claim, loss, liability, damage, cost or expense (including reasonable legal costs) arising from your breach of these Terms, your unlawful use of the Website, or your infringement of any third party's rights.
---
## 15. GENERAL
15.1 **Changes.** We may amend these Terms at any time by posting the updated version on the Website. The version in force at the time you place your order applies to that order. Continued use of the Website after an amendment constitutes acceptance of the amended Terms.
15.2 **Electronic communications.** You consent to receiving communications from us electronically. In terms of ECTA, all agreements, notices, disclosures and other communications sent electronically satisfy any legal requirement that they be in writing.
15.3 **Notices.** Notices to you will be sent to the email address on your account. Notices to us must be sent to HISHANDIWORKZA@OUTLOOK.COM and, where legal service is required, to the address for service in clause 1.
15.4 **Whole agreement.** These Terms, together with the Delivery and Refund Policy and the Privacy Policy, constitute the entire agreement between us and supersede any prior representation, warranty or agreement.
15.5 **No waiver.** Our failure to enforce any provision is not a waiver of our right to enforce it later.
15.6 **Severability.** If any provision is found to be invalid, unlawful or unenforceable, it is severed and the remaining provisions continue in full force.
15.7 **Cession.** You may not cede or assign your rights under these Terms without our written consent. We may cede our rights and delegate our obligations to any successor in title.
15.8 **Links.** The Website may contain links to third-party websites. We do not control them and are not responsible for their content, products or privacy practices.
